Terms and Conditions.

Please read these terms and conditions carefully before continuing with your booking. These Terms and Conditions (T&C’s/ T&C) form a binding contract between Picaboo Pictures (Us/the Company/the Photographer) and you (the Client).

Continuing with your booking and/or payment of the $80 non-refundable fee indicates your agreement to these terms and conditions.

Picaboo Pictures reserves the right to change these Terms & Conditions at any time and will provide reasonable notice to customers of any changes.

General

These Terms and Conditions form a binding contract between the customer and the photographer, agreed to upon booking. Customers will receive the T&C’s prior to booking. No variations or agreed termination of these terms and conditions (or any referenced documents) shall be effective unless in writing.

This agreement and any disputes or claims arising from it shall be governed by and construed in accordance with the laws of New Zealand.

Acceptance

Your written booking and/or payment of the $80 fee signifies acceptance of these T&C’s as a legally binding contract, unless explicitly objected to in writing before accepting Picaboo Pictures’ service. No variations of this contract shall be recognized unless agreed to in writing.

Any booking or payment made to Picaboo Pictures (including the session fee to secure your booking) indicates that you have read, understood, and agreed to all terms and conditions in this document. If this contract must be enforced, you agree to mediation instead of court proceedings.

Copyright & Ownership

The copyright and all other rights in the photos are retained by Picaboo Pictures and the photographer. The photographer asserts the right to be credited as the author of the photographs in accordance with sections 77 & 78 of the Copyright, Design and Patents Act, 1988. Unauthorized reproduction or modification of any image will constitute a breach of copyright, including making copies or ‘screen shots’ of images shared online.

After the shoot, previews or access to an online gallery of images will be shared. These images must not be copied, screenshot, downloaded, edited, or altered in any way.

Photos may be shared on your own network (including social media) only after purchase and payment, including crediting the photographer’s company, Picaboo Pictures, and their social media or website www.picaboopictures.com.

Photographs are licensed for personal use only and cannot be used for commercial purposes. Clients are not permitted to take their own photographs during any portrait photography session.

Reservations and Payment

The $80 payment includes the session fee, a private viewing, and 2 edited digital files. Payments will be collected through invoicing prior to the shoot.

The session fee is non-refundable and contributes to the photographer’s time planning your shoot and providing necessary information for your session. $25/session will be donated towards the Navy Cadets.

Immediately after the photoshoot, you can select the 2 images included in the package and purchase additional edits at regular rates, available at www.picaboopictures.com. An agreement on the purchase of additional images will be made during the viewing consultation, and an invoice will be sent to the customer. Final edited images will only be released after payment is received.

Picaboo Pictures Obligations

Picaboo Pictures and their photographers will use reasonable endeavours to provide the described photography services in a professional manner.

Picaboo Pictures, their staff, and photographers reserve the right to decline booking or performing any portrait sessions or services that pose a health and safety risk.

Your Obligations

You agree to assist and cooperate with the photographer in all matters relating to the photography service and to provide all requested information. You agree to ensure that all participants, including pets, are well-rested and cooperative.

While the photographer will make every effort to ensure an enjoyable experience, they are not responsible for uncooperative participants, which may impact the number and quality of captured images.

You agree to take full responsibility for your safety and that of your children and pets throughout the session. You acknowledge additional hazards on a professional photography set and agree to remain vigilant.

You agree not to take your own photos during the session or take screenshots of images before purchasing.

Session Times and Duration

Please arrive on time for your session and inform the photographer if you anticipate being late. Arrive at least 10 minutes early to ensure a smooth flow of the day.

If informed of your late arrival in a timely manner, the photographer will try to adjust your session time if possible, without impacting other customers’ sessions. If you are more than 10 minutes late without informing Picaboo Pictures, your session will be cancelled with no refund or re-shoot provided.

Creative License

You grant the photographer full creative license to shoot, select images, and deliver them in their chosen style and method.

Special Image Requests

The photographer will make efforts to comply with specific photo requests, but cannot guarantee all requests will be fulfilled, especially those deemed unsafe.

Image Archiving

Picaboo Pictures will retain all RAW images for up to 1 year after your photoshoot session. Additional images can be purchased within this period. After 1 year, RAW images may be deleted.

You are responsible for backing up all digital files after receiving the final images, as they will only be retained for 1 year.

Data Protection

Picaboo Pictures will store client names, contact details, and session information privately and will not share them with other businesses or organizations.

Photos requested for printing will be shared with our collaborating printing company, Skar Image Lab, along with the customer’s name and address if delivery is requested.

Liability

In the unlikely event of technical problems, photographic failure, or loss of images before delivery, our liability is limited to a full refund of all monies paid.

Picaboo Pictures is not liable for any acts, events, or accidents beyond our reasonable control, including strikes, utility failures, acts of God, war, civil commotion, compliance with laws, weather conditions, or third-party defaults.

In the event of incapacitating illness or injury to the photographer, we will try to find a replacement photographer. If a replacement cannot be found, we will reschedule the photoshoot session. If no mutually agreed time is found within 3 months, a full refund will be provided.

Directions issued during the photoshoot are at the client’s own risk. Picaboo Pictures is not responsible for personal accidents during shoots.

While Picaboo Pictures collaborates with high-quality business partners, we are not responsible for the quality of their services.

Image Permission Release

Minishoot sessions include a full Image Permission Release. By booking, you agree to allow Picaboo Pictures to use the photos for promotional purposes, including social media and printed materials. Surnames and specific address details will not be included without your consent.

If you prefer not to give a full image permission release, you may book another session at standard rates.

Covid Regulations

Sessions will be planned with additional precautions as required by the NZ government, including wearing face masks, avoiding unnecessary physical contact, ensuring sufficient airflow, and using hand sanitizer and disinfectant wipes.

If you experience COVID-19 symptoms or are required to isolate, inform Picaboo Pictures immediately. We will reschedule your shoot free of charge.

Picaboo Pictures cannot guarantee a 100% risk-free environment. Continuing with your booking and attending the session constitutes acceptance of this risk. Consider any health conditions before booking.

If rescheduling due to COVID-19, the shoot must be taken within three months of the original date or after a lockdown lift.
